The website www.birrificiodeicastelli.it is owned and managed by Birrificio dei Castelli di Petroni Giovanni & Coppa Roberto snc (hereinafter simply Birrificio dei Castelli), a company with registered office in Arcevia (AN), Via S. G. Battista 37, VAT number 02513760427, tel. 3200671253, info@birrificiodeicastelli.it. Users are invited to carefully review this document before using the services.
Birrificio dei Castelli reserves the right to modify these conditions without prior notice. Use of the site implies acceptance of the changes.

The purchase is reserved for individuals who are at least eighteen years old. Placing an order and making a payment implies acceptance of our terms and serves as a declaration of legal age. In any case, parents are directly responsible for the payment of items purchased by their children under the age of eighteen, without prejudice to the right of withdrawal.

Prices and product availability

The prices of the products for sale on the website are expressed in Euros (€) and include VAT. Prices and availability are subject to change without notice. The cost of shipping, where applicable, will be added to the product price at checkout. If the product is unavailable, the customer will be promptly informed via email and offered a refund or a coupon of equal or greater value as compensation.

Limitation of liability

Birrificio dei Castelli assumes no responsibility for any losses or damages, whether direct or indirect, present or future, to any natural or legal person resulting from use or misuse of the service provided by the website www.birrificiodeicastelli.it. The user who interacts with the site expressly exempts Birrificio dei Castelli from this form of liability. Birrificio dei Castelli does not guarantee that the services provided by www.birrificiodeicastelli.it will be uninterrupted. Under no circumstances shall the consumer be entitled to anything other than a refund of the amount paid.

User Responsibility

The user is required to ensure that the data provided is truthful, complete, and up to date, and to promptly communicate any changes to such data. Birrificio dei Castelli is not responsible for errors in delivery, or for failure to deliver, if an incorrect, non-existent, unclear, ambiguous, or test address and/or availability was provided.

Right of Withdrawal

Given the characteristics of the product, the consumer may exercise the right of withdrawal within 14 working days from the date of receipt of the goods. To cancel an order, please contact the number 3200671253 at your own expense or send an email to inf@birrificiodeicastelli.it. Order cancellation and the related refund can only occur if the products are returned in good condition, without signs of opening. The costs and risks associated with the return of the products will be borne by the consumer. It is specified that EU regulations stipulate that the right of withdrawal can only be exercised by individuals (consumers) acting for purposes that can be considered unrelated to their commercial activity. The right of withdrawal does not apply to the supply of goods that are made to order or clearly personalized, or which, by their nature, cannot be returned or are at risk of deteriorating or changing rapidly. It is further specified that, in the case of promotional offers (so-called promotions), where the purchase of one product is paired with another product sold at a very low price or even given for free, the right of withdrawal can only be legitimately exercised with the return of both items involved in the purchase, given the accessory nature of the promotional item in relation to the primary product.

Delivery

The estimated delivery times are 2-5 working days for deliveries in Northern and Central Italy, and 3-6 working days for deliveries to Calabria, Sicily, Sardinia, the Venetian Lagoon, minor islands, and remote locations. Any claims for damages during transport can only be processed if the “acceptance with reservation” clause is indicated at the time of delivery. Birrificio dei Castelli will not be liable, by way of example, for loss of profit, present and future damages, third-party damages, damages to property or persons, and/or capital losses, in all direct and indirect forms. In particular, no compensation may be requested for losses caused by issues attributable to the courier.

Force Majeure

Birrificio dei Castelli will not be responsible for the inability to complete the order and successfully ship the products if such inability is due to circumstances beyond the direct control of Birrificio dei Castelli, including, but not limited to: changes in laws or government regulations, fire, theft, strikes, natural disasters, wars, national emergencies, or power outages.
Birrificio dei Castelli is also not liable for damages or failed deliveries caused by a change in even a single condition of payment or shipping.

Competent Court

The terms and conditions will be interpreted according to Italian law and commercial practices, under the jurisdiction of the Court of Ancona.
